This Privacy Policy describes how ZAIKU LLC, a Texas limited liability company ("ZAIKU," "we," "us," or "our") collects, uses, and shares information when you use the websites, mobile applications, software-as-a-service products, and other services we operate (collectively, the "Services"), including the website at zaiku.app.

By using our Services, you agree to the practices described in this Policy. If you do not agree, do not use the Services.

2. Age Requirements & Children's Privacy

ZAIKU LLC operates a range of products for different audiences. The intended age range for each product is clearly stated on its product page and in its in-product disclosures. Some products are designed for adults (17+), some are designed for general audiences (13+), and some are designed specifically for children (under 13) and their families or educators.

2.1 Adult and general-audience products

For products intended for users 17+ or 13+, we do not knowingly collect personal information from anyone under 13. If you are a parent or guardian and believe your child under 13 has provided us with information through one of these products, please email privacy@zaiku.app and we will delete it promptly.

2.2 Child-directed products (COPPA)

For products that are specifically designed for children under 13 (including educational and family products), ZAIKU LLC complies with the Children's Online Privacy Protection Act (COPPA). For these products:

• We collect only the minimum personal information from a child necessary to operate the product;
• We obtain verifiable parental consent from a parent, legal guardian, or — for educator-licensed deployments — from a school acting on behalf of parents under applicable federal guidance, before knowingly collecting personal information from a child under 13;
• We do not use a child's personal information for targeted or behavioral advertising;
• We do not sell, rent, or trade a child's personal information;
• We do not condition a child's participation in an activity on disclosing more information than is reasonably necessary;
• Parents and educators may review, request deletion of, and refuse further collection of their child's or student's personal information at any time by contacting privacy@zaiku.app;
• We retain a child's personal information only as long as necessary to provide the service and then delete it.

2.3 Schools, educators, and student data (FERPA / state student data laws)

When a school, district, teacher, or other educational institution provides ZAIKU access to student information for educational purposes, ZAIKU acts as a "school official" with a "legitimate educational interest" under the Family Educational Rights and Privacy Act (FERPA) and uses student information only for the educational purpose for which it was provided. We comply with applicable state student data privacy laws, including but not limited to Texas Education Code Ch. 32 (Subch. M), California SOPIPA, and similar laws in other states. We do not sell student information, do not use it for targeted advertising, and do not build user profiles for non-educational purposes.

3. Information We Collect

3.1 Information You Provide

• Account & profile information — name, email address, and any profile details you provide when you sign up for a ZAIKU product.
• Content you submit or upload — including photos, files, text, ideas pitched through our forms, and messages sent to our team. The specific data each ZAIKU product collects is described in the in-product privacy disclosures.
• Purchase & subscription information — when you buy or subscribe to a ZAIKU product, the relevant app store or payment processor (e.g., Apple App Store, Google Play, Stripe, RevenueCat) handles your payment. We receive transaction confirmation only. We do NOT receive or store your payment card information.
• Support communications — messages you send to any ZAIKU contact address, along with our responses.

3.2 Information Collected Automatically

• Device identifiers — anonymous identifiers (e.g., Apple IDFV, Android Advertising ID) used to operate the product, enforce free-tier limits, and prevent abuse.
• Usage data — features used, screens viewed, conversion events, anonymized engagement metrics. Used to operate and improve the product.
• Diagnostic & crash data — anonymized stack traces and error logs (e.g., via Firebase Crashlytics) to identify and fix bugs.
• IP address & routing metadata — for fraud prevention and edge-network routing. Not retained long-term in identifiable form.

3.3 Information We Do NOT Collect

• We do NOT collect your government IDs, phone number, or postal address unless a specific product clearly explains why it needs them.
• We do NOT track you across other apps or websites.
• We do NOT use cross-app advertising tracking identifiers.

4. How We Use Information

We use the information we collect to:

• Provide, operate, and improve our Services;
• Process and verify purchases and subscriptions;
• Enforce free-tier limits, prevent fraud, and protect against abuse;
• Diagnose crashes, fix bugs, and improve product stability;
• Respond to your support requests and communications;
• Review and follow up on ideas, problems, and feedback you submit; and
• Comply with applicable legal obligations.

We do NOT sell your personal information to advertisers or data brokers. We do NOT use your content (photos, files, text) to train third-party AI models on your behalf, except where strictly required to deliver the service you requested (for example, sending a photo you uploaded to an AI provider so it can generate the output you asked for).

5. Third-Party Service Providers

To operate our Services, we share limited data with the following categories of service providers, each subject to their own privacy policies:

Each ZAIKU product's in-product privacy disclosure lists the exact providers that handle your data for that product.

6. Data Retention

• Content you upload (e.g., photos, files) is retained only as long as needed to deliver the service you requested — typically 30 days or less unless a specific product clearly states otherwise.
• Account information is retained while your account is active, and for a reasonable period after deletion to comply with legal obligations.
• Purchase records are retained for the period required by tax and consumer law (typically 7 years).
• Anonymized analytics and crash data may be retained for up to 14 months.

You may request earlier deletion at any time by emailing privacy@zaiku.app.

7. Your Rights

Depending on where you live, you may have the following rights with respect to your personal information:

• Access — request a copy of personal data we hold about you;
• Correction — request that we correct inaccurate data;
• Deletion — request that we delete your data;
• Portability — request your data in a portable format; and
• Opt-out — opt out of certain processing.

To exercise any of these rights, email privacy@zaiku.app. We will respond within 30 days (or as required by applicable law).

California Residents (CCPA / CPRA)

You have the right to know, delete, correct, and opt out of "sale" or "sharing" of personal information. ZAIKU LLC does not sell or share personal information as defined by California law.

Texas Residents (TDPSA)

Under the Texas Data Privacy and Security Act (Tex. Bus. & Com. Code Ch. 541), effective July 1, 2024, Texas residents have the right to:

• Confirm whether ZAIKU LLC is processing your personal data and access that data;
• Correct inaccurate personal data;
• Delete personal data we have collected about you;
• Obtain a portable copy of your personal data; and
• Opt out of (a) targeted advertising, (b) the sale of personal data, and (c) profiling in furtherance of decisions that produce legal or similarly significant effects.

ZAIKU LLC does NOT sell personal data, does NOT engage in targeted advertising, and does NOT conduct profiling that produces legal or similarly significant effects. To exercise any of the rights above, email privacy@zaiku.app. We will respond within 45 days. If we deny your request, you may appeal by replying to our response email; if we deny your appeal, you may file a complaint with the Texas Attorney General at texasattorneygeneral.gov.

EU / UK Residents (GDPR / UK GDPR)

Our legal basis for processing your data is (a) your consent (by using the Services), (b) contractual necessity (delivering the service you requested), and (c) legitimate interest (fraud prevention, product improvement). You have the right to lodge a complaint with your local data protection authority.

8. User-Submitted Content

You are solely responsible for the content you upload, submit, or share through our Services. By submitting content, you represent that you have the right to do so and that the content does not violate the Terms of Service or applicable law. We reserve the right to remove content that violates our policies or to terminate access for repeated violations.

9. Security

ZAIKU LLC implements reasonable administrative, technical, and physical safeguards to protect your data, including HTTPS encryption in transit, encrypted storage at rest, and access controls on backend systems. No system is 100% secure, and we cannot guarantee absolute security. If we become aware of a data breach affecting your personal information, we will notify you and applicable authorities as required by law.

10. International Data Transfers

Your data may be processed in the United States (where ZAIKU LLC and most of our service providers are based) and potentially other jurisdictions. By using the Services, you consent to this transfer. Where required, we rely on standard contractual clauses and other lawful transfer mechanisms.

11. Changes to This Policy

We may update this Privacy Policy from time to time. When we make material changes, we will revise the "Last updated" date at the top and, where appropriate, notify you through the Services. Your continued use after changes take effect constitutes acceptance.
